British Legal Experts Caution of ‘Dangerous Precedent’ Following Removal Proposal from Conservative Politician

Prominent UK attorneys have issued warnings about a political “race to the bottom”, after a Conservative MP seen as a potential leadership candidate suggested that large numbers of lawfully resident households must be removed from the country.

Divisive Remarks on Legal Status

The MP, a shadow Home Office minister and a Tory whip, stated that individuals with legal status in the UK should have their right to stay cancelled, to guarantee the UK remains mostly “culturally coherent”. The Conservative leader, the party head, later retreated from Lam’s statement recently.

While Badenoch initially said the remarks were “generally consistent” with party policy, she later returned to current rules that only withdraw indefinite leave to remain (ILR) status if someone has broken the law. Nevertheless, the statement has raised alarms for many as a signal of “perilous periods” and belonging to a larger political discourse.

Growing Trend of Immigration Criticism

In the past few months, politicians across political parties have adopted anti-migrant rhetoric and echoed proposals that were once seen as extreme. Lately, a Reform UK leader expressed dissatisfaction about “numerous advertisements” seemingly featuring “black and Asian people”, and in September, the group’s head, the figurehead, pledged to abolish the primary pathway for migrants to obtain British citizenship.

Earlier this year, Keir Starmer said the UK faced the danger of becoming an “nation of foreigners” without tougher immigration policies.

“I don’t accept that the implications of that phrase were not comprehended, and it was targeting a specific group,” said a leading barrister, who has investigated claims of racism within Labour.

The barrister, whose parents emigrated from the West Indies, said Lam’s comments were a barely concealed racial purity campaign”. The leading barrister said the current political discourse was an “utter condemnation” that someone like himself, from multiple generations of people who had contributed to the country, should still feel insecure.

“We’re in a downward spiral,” added the lawyer. “It’s alarming to see the opposition feeling the only answer to the rival party is to try and out-Reform Reform, rather than actually discuss the benefits of migration.
“The rhetoric has to evolve and has to be truthful.”

National Mood and Far-Right Activity

Backing for the party has surged in the surveys, and far-right marches have drawn thousands to the capital, leaving many British people of colour feeling the circumstances are reminiscent of far-right marches from decades past and concerned the UK is “going backwards” as elected officials target migrants.

“These are perilous times,” said Jacqueline McKenzie, who has acted for hundreds of affected individuals at the centre of the residency controversy, in which UK citizens from the former empire residing in the UK lawfully were mistakenly categorized as illegal migrants.

McKenzie said her parent, who emigrated to the UK from the Caribbean in 1951, would be rolling in his grave over the present debate. Lately, her daughter has asked whether they should get Caribbean passports.

“Currently we see kids in their twenties and thirties who have got two generations ahead of them, UK-born, feeling less than,” said the attorney.
“We are in really, really dangerous times where anti-immigrant fervour is being seen as a legitimate policy orientation for many groups,” she added. “The tenets of this, the reach of it extend widely when you start talking about deporting and removing people who are lawfully resident, and millions of them as well. That’s something very different, isn’t it?”

Personal Impact

People with permanent residency, or with partners who hold this status, have expressed that the recent policies suggested by political figures have left them feeling uncertain in the UK, and characterized the wider political debate as racist, alarming and hostile.

One individual, a dual British-Jordanian citizen residing in Manchester with his wife and children, said the recent surge of the party in the polls had motivated him to get his UK passport. For the last several years he has gone through the procedure of securing ILR – at a huge financial cost – after relocating to the UK on a marriage permit. Should the proposed policies be implemented, he worries his family would be separated.

“It’s easy for someone to say now, well, that will never happen,” said the man, 37. “Who knows how this plays out in the coming years.”

While day to day, he has “no issues”, Darwazeh has been concerned by the increase of national symbols in his neighbourhood, a practice that has been widely adopted by the far-right and immigration opponents. In the future, though the family has no wish to leave, they may consider it if the unfriendliness persists.

“I find it really odd that in a nation where migrants are needed, no one’s actually selling a positive story about immigration at all,” he remarked. “I just find the demonisation very peculiar and frightening, for the future.”
